Governor Newsom vetoed a decriminalization bill (SB 58) in 2023, and a regulated-therapy bill (SB 1012) died in committee. A bipartisan pilot, the Heal Our Heroes Act, would have let San Diego, San Francisco, and Santa Cruz run supervised psilocybin programs for veterans and first responders; it also died in committee. Newer veteran-focused proposals and a 2026 ballot effort continue the conversation, but as of 2026 no regulated program exists, and psilocybin remains Schedule I under state and federal law.

San Diego has not passed a local deprioritization measure, unlike Oakland, San Francisco, Santa Cruz, Berkeley, and a few other California cities. Most people here access care through medical ketamine and esketamine, through clinical trials at local research institutions, or by traveling to licensed psilocybin services in Oregon or Colorado.
